A Letter From Sen. Drilon to Atty. Marcelo...

Dear Atty. Marcelo,
We respond to your letter dated October 6, 2010.
We fully understand the importance of providing adequate funds for the Judiciary and the need to comply with the const itut ionally mandated financial guarantees and fiscal autonomy to the Judiciary.
As a background, a Special Allowance for the Judiciary was authorized pursuant to the Republic Act No. 9227 entitled "An Act Granting Additional Compensation in the Form of Special Allowances for Justices,Judges and All Other Position in the Judiciary with the Equivalent Rank of Justices of the Court of Appeals and Judges of the Regional Trial Court, and for Other Purposes". The provisions of this law, which was enacted in November 11, 2003 is summarized, as follows :
a) A Special Allowance shall be granted t o members of the Judiciary
equivalent to one hundred percent (100%) of their basic monthly
salary specified for their respective salary grades under Republic Act
No. 67S8. This Special Allowance will be spread over four years until the 100%of their basicsalary is reached.
b) All special allowancesgranted under R.A. No. 9227, and any additional allowances granted to other personnel of the Judiciary is considered an advance implementat ion of any salary increases which may be provided by law
